Mayor Eric Adams argued in new court filings that his administration has special authority as an “arm of the state”—part of an ongoing lawsuit filed in February over City Hall’s refusal to implement a suite of laws to expand access to city-funded rental vouchers.
Mayor Eric Adams’ administration is doubling down on its refusal to implement a suite of laws to expand access to city-funded rental vouchers, arguing in new court documents that the City Council has encroached on the Department of Social Services’ authority to administer the voucher program as an “arm of the state.”
New York’s Social Services Law empowers certain state agencies—the offices of Temporary and Disability Assistance (OTDA) and Children and Family Services—to set public assistance policy, city lawyers argued. And these state agencies, in turn, extend authority to local Department of Social Services (DSS) commissioners.
In the case of New York City, that’s Commissioner Molly Wasow Park. It’s up to her to implement local laws, subject to OTDA’s approval, according to the city.
“City DSS has declined to undertake rulemaking to implement the… new laws because City DSS, and not the City Council, is empowered to set eligibility criteria for social services housing supplements like CityFHEPS,” they argued.
The new filings are part of a lawsuit that the Legal Aid Society filed in February on behalf of a proposed class of New Yorkers who are either homeless or at risk of eviction. The City Council has since joined the lawsuit, and rejected Adams’ reasoning in a brief statement Wednesday, calling the preemption argument “unfounded.”
Both parties have pointed to historical instances of the City Council legislating CityFHEPS reforms, including increasing the value of the vouchers in 2021.
The lawsuit claims the plaintiffs should be eligible for City Family Homelessness and Eviction Prevention Supplement (CityFHEPS) rental vouchers, but are closed out because the Adams administration hasn’t implemented laws expanding the program, which the Council passed over mayoral veto last summer.
Under CityFHEPS, tenants pay up to 30 percent of their income on rent while the city covers the rest, up to a fixed maximum. The Council package expanded CityFHEPS eligibility for people at risk of eviction, raised the income ceiling, and eliminated work requirements, among other reforms.
The Adams administration unilaterally implemented one of the reforms last year, nixing a 90-day waiting period to access vouchers in shelter. The city also added flexibility to how vouchers cover utility costs, albeit not exactly aligned with the Council laws.
Robert Desir of Legal Aid’s Civil Law Reform Unit, an attorney on the case, said Wednesday that his clients agree that the Adams’ administration has to present an implementation plan to the state for approval. But that doesn’t mean the Council can’t compel it to do so.
“The city hasn’t taken any steps to deal with the changes that the City Council made, and there’s clearly a role for the City Council to play in providing for the welfare of people in the city,” Desir told City Limits.
The City Council has not overstepped its authority, he added. “They’re not saying that the city has to implement the laws in a specific way. That’s up to the city, and up to state law,” he said. “But they are saying that they do have to take steps to implement the laws. And that would be the first step—devising a plan.”
Also on Tuesday, City Hall argued that the amount of funding available for CityFHEPS is finite, and that Legal Aid is saying vouchers should be issued to everyone who is eligible, which would violate the mayor’s budgetary authority.
“I don’t think that the city’s budgeting powers are curtailed in the way that they say that they are,” Desir of Legal Aid said. “I think flexibility remains.”
Desir also responded to a brief submission from City Hall arguing that some of the plaintiffs could be eligible for support outside of the expanded CityFHEPS program.
For example, the city said plaintiff Mary Cronniet, an 86-year-old widow at risk of eviction, could potentially qualify for an Adult Protective Services case, one of the few paths to CityFHEPS for people living outside shelter under the old regime.
This doesn’t change the fact that she and her co-plaintiffs should be able to apply for expanded CityFHEPS, Desir countered: “What we’re saying is our clients should be able to apply.”
Various cost estimates have been floated for the expanded program.
The Adams administration estimated the full package would cost about $17 billion over five years, while the City Council has posited $10.6 billion. The Community Service Society of New York (a City Limits funder) has predicted a net cost of $3 billion over that period for newly-eligible households facing eviction.
Louis Cholden-Brown, a Council veteran who was deputy counsel to former Speaker Corey Johnson, said Wednesday that these estimates are almost beside the point, because the program will ultimately cost as much as the city agrees to appropriate.
“CityFHEPS only has to be available to the extent that it’s funded,” he said.
In an affirmation Tuesday, Sara Zuiderveen, DSS’s senior advisor for housing and homelessness, argued that due to funding limitations, implementing the full package would not translate to more New Yorkers receiving vouchers.
Instead, some amount of the finite resource would shift to “households in the community who have higher incomes and are less vulnerable to becoming homeless.”
Homelessness is costly, Desir argued—both financially and to the extent that it takes a toll on individuals and families. Ultimately, the program deserves a large investment to serve more New Yorkers overall.
“There’s been a lot of argument about… what funds are available,” he said. “I think that this is something that should be prioritized.”

I am a New Yorker I have been in the shelter system and my experiences was bittersweet. My first apartment was on Nycha at Drew Hamilton houses my apartment was broken into on October 31st 1999. From that day on with me being victimized through robbery and this place and dislocated I never received another apartment again in New York City as of yet and while I went into the shelter system again I didn’t secure permanent housing for me and my kids I am currently homeless and when I say homeless I mean I’m homeless without my own unit for me and my kids to call my own I live with a relative that is unstable to be with and I need a place for me and my children I even took and left New York City twice and the third time I was talked about and criticize from the people of New York about when I relocated at after the fact that they did not ever give me another apartment in New York City to live in with my children and I mean it seem like they hunted me down because they talked about me so bad when I moved and out of New York City that I actually had to come back to New York City because the people started treating me some kind of way because they told the people that I was wanted and I was wanted from what I didn’t understand that and they even made jokes about it so I felt disrespected and I left because of unfortunate event that it was a death that requires me to leave and just clear my mind so I came back to New York City and I would try to go into the shelter system again but they told me that they didn’t want me back in and they rejected me and they told me they just wanted to see me on the news why that was told to me I don’t know I could assume but my consuming doesn’t mean that it was right to say that that’s what it was so here I am in 2024 without a place of my own for my kids we are living now with my sister I’m being harassed I’m being harassed threatening and I was beaten last year from her neighbors with her kids and her husband and some other grown men they beat me and my sister and the hallway of our nycha building and sent us to the hospital with injuries nobody was arrested because they made it seem like it was just one individual when it was a group of people plus people additional people inside the building I called around to victim services I got no help from victim services they just told me to go back into the shelter now meanwhile I’m being harassed from the individual and individuals that physically assaulted me last summer on nycha nobody was arrested and nobody was prosecuted because they wanted me to prosecute a child when it wasn’t a child it was a child’s parent telling the child to fight me that had bipolar disorder and as if that was funny just this Saturday we just passed she threatened me again with the same individual that don’t live on housing premises but she comes to fight up on me and people when her mother tell her to so now it was reported but nobody did anything it’s like when I go to say something I get retaliated against and that’s not fair I’m writing this to y’all because I see that you’re having a debate about s*** people be granted section 8 vouchers from the mayor because of the homeless system that’s out of control in New York City and I think he should Grant homeless people shelters through the section 8 vouchers I’m one of them that’s homeless but I’m not just homeless I’m being harassed and threatened and beaten as a victim I’m still facing this situation and with my sister and her neighbors now some of the neighbors that has something to do with it they left off the floor cuz I guess they felt embarrassed but the one two particular neighbors one said they own housing they said they have she is in housing that they own houses and they can throw people out when they feel like it then the other one is the enforcer she goes around and be people in and report stuff and do bad things and blame people for bad things they know who she are they know who they are just last week she had somebody beating on my sister I mean beating on the door calling her name as if she lived in my sister home at one time I thought the person was just going to bust through the door I reported it tonight you I’m being retaliated back against so I need someone to reach out to me concerning this matter because I have not gotten an answer from victim services other than going to the shelter now I can go into the shelter but I don’t need to be rejected plus the shelves is over crowded so why would I make it even more crowded with me going in with this stupid situation that don’t have nothing to do with me but I’m being put involved in it it said because we need to place this day and I mean I’ve been facing this issue with this individual families for years and it has to come to some type of resolution I mean she does everything she have done everything and I mean everybody pretend that they scared of her they don’t know what to do with her and it’s just out of control she really needs some intervention but they making it seem like nobody cared for her I’m the only one seem like I care for her despite that she’s making me a victim of hers it was sad that I got beaten in front of my daughter like if I was some creature that was unknown and I needed to be beaten like that then nobody did nothing about it they made it seem like it was only her daughter that had bipolar which live in Jersey but she comes to fight up on people in New York City so nobody seem like they needed to address that issue properly I need some help I need a resolution on how I can remove myself because they do follow me and report me on everything and I mean I’m not in a space if I’m in your space as me being a person let me come out of your space instead of you following me and harassing me and report me and talking about me as if I’m doing something to you just to be a monitoring spirit in a bad evil one at that so I’m homeless within being in an apartment and I don’t understand how you in the apartment and you still homeless that’s crazy to me but here I go reaching out for help again I need some answers okay this person has violated not me just multiple people and I mean I’m not going to keep fighting with her because I don’t have to I don’t have to have bloodshed just get answers from society because it’s wrong and I can’t make people wrong right they have to do that I need some help I mean her and her family is even in the school system arresting my daughter in school trying to have the kids to fight up on her telling the teachers to do different things to her that they either know or correspond with I mean it’s really out of control
Funding might limit who gets helped. Councilman Cholden-Brown seems to be saying the program can only serve as many people as it has funding for.
